DiskFaktory, the leading provider of End to en Artist Services including design, mastering, duplication and replication services, has set up an affiliate program
for music labels, production companies, rehearsal studios, and recording studios.

As a DiskFaktory affiliate you will receive 10% of any sale made
through the affiliation.
This document outlines the requirements and responsibilities for all new DiskFaktory CD/DVD duplication Industry Affiliates.

Process
The DiskFaktory link should offer easy access to log on to the DiskFaktory process, where the visitor can upload their songs and artwork, and complete their order with a credit card transaction.
All DiskFaktory affiliates are paid a straight 10% commission on gross sales of duplication packages, rush charges, poster sales, and t-shirt sales from said site/link. (tax , MFA charges, MAN charges and shipping/handling not applicable).

Affiliate Requirements
To ensure a healthy return for all involved parties, DiskFaktory will require:

You agree to distribute a unique coupon code to your clients for the
tracking of non-link initiated sales, sales transacted via phone or email
per your affiliation.

House accounts and existing DiskFaktory customers are exempt from
this agreement, and will remain DiskFaktory customers with all
proceeds going to DiskFaktory.

The affiliate must give a thirty (30) day notice of the intent to discontinue their affiliation. The affiliate’s full commission due will be paid at the end of that
thirty (30) day period.

The affiliate agrees to maintain standard business practices whiles dealing with all prospective clients. Any deviation from standard business practices will result in a breach of this agreement and the termination of the affiliation.
All commission from applicable sales conducted under reasonable standard business practices will be computed and paid sixty (60) days of the breach.

DiskFaktory Responsibilities

A 10% commission will be paid on the final price (minus up to 5% maximum
discounts if given by the affiliate) of shipped package sales, rush charges,
poster sales, and T-shirt sales, not including any applicable taxes,
MFA charges, or shipping.

Commission will be paid monthly on shipped package sales provided that the commission exceeds $200.00.
If the total commission for any month, or the total commission due from previous
months is less than $200.00, commission will be re-calculated the following
month and the total re-evaluated.

Completion of a signed affiliate agreement must be on file or accepted before commissions may be accrued.

DiskFaktory will produce finished product that is a professional representation
for your customer done affordably and delivered quickly directly to your customers DiskFaktory will treat all your referred customers as if they were our own with exceptional customer service and quality products.

Collection of all funds for said service(s)

Affiliate Information Changes
It is the Affiliate’s responsibility to notify DiskFaktory of any changes in
business name, contacts, address, phone or email. DiskFaktory will send all correspondence to the most recent information provided by the Affiliate
and will not responsible for outdated account information.

Without limiting either party’s right to terminate this agreement at any time,
please take note that DiskFaktory will also initiate Affiliate termination action if the Affiliate fails to respond to any confirmation emails, letters and/or phone calls
in a timely fashion.

General Terms of Agreement
The term of this Affiliate Program agreement commences upon Diskfaktory's
acceptance of the Affiliate’s enrollment application.
Either has the right to terminate this agreement and a Affiliate’s participation in the program at any time, with or without cause, with a 30 days notice thereafter
in writing via mail or email. Affiliate referrals accepted prior to termination
shall continue to be covered by this agreement.

The terms and conditions of the DiskFaktory’ Affiliate Program are subject
to change and termination without notice, except for referral projects
accepted by DiskFaktory prior to the effective date of such
changes or termination.
Any changes to the terms of Affiliate Program on the DiskFaktorys’ website
shall be deemed adequate and full notice to all Affiliates.
The terms hereof cannot be modified except through this website or a
writing signed by the management of DiskFaktory.

This agreement shall be governed under the laws of the State of California,
and unless DiskFaktory elects otherwise, any dispute under this
agreement shall be resolved only in the courts located in the
State of New Jersey to which jurisdiction all Affiliates hereby submit.

I hereby accept the above terms and agree to act as a
DiskFaktory Affiliate in good faith subject to the terms of this agreement.
